Some critics might say too late.

I agree with your analysis of dynamics between both parties.

Might we apply GDPR terminology and call OpenAI a “Data Processor” because they

“...process personal data on behalf of the Controller”

The end user would be a Controller since they provide the instructions about processing activities and are responsible for processing.

That's an interesting point. I think OpenAI also qualifies as a Controller here because it's system operates based on a set of learned rules. It is also true that the user has influence here which goes beyond that of typical applications. So, I'd say OpenAI is the data processor and both it and the user are Controllers, but maybe we should have a lawyer weigh in. 😀
